Terms of Service

Read the terms and conditions that govern your use of LangGrade.

1. Acceptance of Terms

By accessing and using LangGrade ("Platform", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all terms and conditions, you must not use our services. These Terms constitute a legally binding agreement between you and LangGrade.

2. Description of Service

LangGrade provides AI-powered language exam practice and evaluation tools for CELPIP, TEF Canada, and TCF Canada. The Platform offers simulated tests, AI grading, vocabulary tracking, spaced repetition flashcards, and performance analytics. LangGrade is an independent practice tool and is not affiliated with, endorsed by, or connected to any official exam body, including Paragon Testing Enterprises (CELPIP), Le français des affaires (TEF), or France Éducation international (TCF).

3. Eligibility and Age Restriction

You must be at least 16 years of age to use the Platform. If you are under 18, you represent that you have obtained the consent of a parent or legal guardian to use the Service. We do not knowingly collect data from users under 16. If we learn that a user is under 16, we will promptly delete their account and associated data.

4. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • One account is permitted per user. Account sharing is strictly prohibited and may result in immediate termination.
  • You are responsible for all activities that occur under your account.

5. Subscriptions, Free Trials, and Payments

  • Certain features require a premium subscription ("Pro Plan"). Subscription pricing is shown during checkout.
  • Eligible plans may include a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your payment method will be charged automatically at the applicable rate.
  • Subscriptions are billed on a recurring basis (weekly, monthly, or annually) as selected during checkout.
  • All payments are processed securely by Stripe, Inc. LangGrade does not store credit card numbers.
  • You may cancel your subscription at any time through your account settings or the Stripe customer portal. Cancellation takes effect at the end of the current billing period.
  • We do not offer refunds for partially used billing periods unless required by applicable law.

6. Acceptable Use

You agree not to:

  • Use the Platform for any illegal purpose or in violation of any local, state, national, or international law.
  • Attempt to reverse engineer, decompile, or extract the source code of the Platform.
  • Abuse the AI features by submitting inappropriate, explicit, or malicious content.
  • Use automated systems, scripts, or bots to access or interact with the Service.
  • Circumvent usage limits, rate limits, or access restrictions.
  • Distribute, share, or reproduce AI-generated feedback for commercial purposes without authorization.

7. AI-Generated Content Disclaimer

LangGrade uses third-party AI models (including Google Gemini) to evaluate your speaking and writing responses. AI evaluations are estimates for practice purposes only and do not guarantee or predict official exam scores. AI-generated feedback may contain inaccuracies. LangGrade does not warrant the accuracy, completeness, or reliability of any AI-generated content.

8. Third-Party Services

The Platform integrates with third-party services, including but not limited to Google Cloud (AI, hosting), Firebase (authentication, database), and Stripe (payments). Your use of those services is governed by their respective terms and privacy policies. LangGrade is not responsible for any third-party service disruptions, data handling practices, or policy changes.

9. Intellectual Property

All content, trademarks, logos, and materials on LangGrade are the intellectual property of LangGrade or its licensors. You may not copy, reproduce, or distribute any part of the Platform without written permission. User-generated content (responses, recordings) remains your property, but you grant LangGrade a limited license to process it for service delivery.

10. Account Termination

  • You may delete your account at any time by contacting support@langgrade.com.
  • We reserve the right to suspend or terminate your account without prior notice if you violate these Terms, engage in fraudulent activity, or abuse the Platform.
  • Upon termination, your access to the Platform will cease and your data will be deleted in accordance with our Privacy Policy.

11. Disclaimer of Warranties

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. LangGrade does not guarantee uninterrupted, timely, or error-free service.

12. Limitation of Liability

To the maximum extent permitted by law, LangGrade and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid to LangGrade in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless LangGrade and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in the Province of Ontario. You agree to waive any right to participate in a class action.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or dashboard announcements at least 15 days before changes take effect. Continued use of the Platform after changes take effect constitutes acceptance of the modified Terms. If you disagree with the changes, you must stop using the Platform and cancel your subscription.
